Cancellation, Rescheduling and Notice

Cancellation, Rescheduling of Services or No-Show Sponsor. All Deposits, Installment Payments and Final Payments are non-refundable. In the event the Provider must cancel, both Parties agree to reschedule the event to a mutually agreed upon date, and any deposits received will be applied towards the future event. If Provider desires to cancel Services, reschedule Services, or if it becomes impossible for Provider to render Services Provider shall provide Notice to Provider as soon as possible via the Notice provisions detailed in this Sponsorship Agreement. 

If Attendee desires to cancel reschedule, or if it becomes impossible for Attendee to participate Attendee shall provide Notice to Provider as soon as possible via writing to deeanna@futurereadycmo.com. 

While we will do our best to attempt to re-book another Attendee to fill the void created by Attendee’s cancellation, Provider has no obligation to do so. Attendee is not relieved of any payment obligations for canceled Services, rescheduled Services, failing to show up for the event, or should it become impossible for Provider to provide the services due to the fault of Attendee (or parties related to Attendee) unless the Parties otherwise agree in writing. 

If it becomes impossible for Provider to provide the Services due to the fault of Sponsor (or parties related to Sponsor), Provider will not be obligated to refund any nonrefundable monies Sponsor has previously paid toward the Fee.

Impossibility. The performance of this agreement by either party is subject to termination without liability upon the occurrence of any circumstance beyond the control of either party such as acts of God, acts of war or terrorism, acts of state or governmental authorities, strike, lockout, material or labor restrictions by any government authority, civil riot, fire, flood, governmental travel advisories, curtailment of transportation facilities, or other similar cause preventing or delaying meeting attendees/guests from attending or another cause beyond the reasonable control of the Contractor or Organizer, including without limitation pandemics or other similar emergencies related to communicable diseases if the WHO, CDC or other federal, state or local governmental agency has issued an advisory recommending against travel to or from Modern Elder Academy, or recommending against gatherings in excess of the Provider’s planned/contracted attendees, to the extent that such circumstance makes it inadvisable, impracticable, impossible or illegal to hold the event or to provide the facility. Upon such circumstance, the Sponsor and Provider hereby waive any claim against the other for damages, cancellation penalties or fees.

Health, Safety and Cancellation due to COVID-19. The Provider is fully committed to addressing the flexibility that guests need in order to navigate the current pandemic and to safely restore in-person meetings and events. The Contractor requires proof of complete vaccination as well as a negative Covid-19 antigen test within 24 hours of arrival at MEA as well as completion of the attached waiver per attendee. Upon departure, if mandated by the transportation authorities, The Provider team can organize a mobile testing unit to visit campus at the guest's expense with an estimated results turnaround time of 24 hours. In the event of a case surge in Covid-19 or any other airborne disease as recognized by the WHO, CDC, or Mexican Health Authorities, The Organizer agrees to comply with the public health requests from The Provider, and enforce masking and/or other precautions among their participants in indicated spaces and events.

As a gesture of goodwill, should the need arise for cancellation due to COVID-19 or a clear and specific Force Majeure cause, the deposit and any payments paid hereunder shall be available to be used toward a rescheduled event.

Accommodations and Additional Fees. Attendees will be provided with hotel accommodations, meals, and transportation to/from Cabo San Lucas Airport and event activities. Additional fees, such as round trip airfare, are applicable and will be booked directly by the Attendee. 

Liability. It is understood that Future Ready CMO is only liable for services completed and provided by Future Ready CMO and cannot be held liable for the services of other contracted vendors. It is understood that in no event shall Future Ready CMO  be liable for consequential damages of any kind.
